1. Scope of application
These general terms of use (hereinafter referred to as the “General Terms of Use” or the “GTU”), set out below, govern access to and use of the Site by any adult natural or legal person (hereinafter the “User”). You must therefore read them before using the Site.
The General Terms of Use of the Site are supplemented by the General Terms and Conditions of Sale concerning the terms applicable to any purchase made on the Site, as well as the Privacy Policy and the Cookie Policy available on the Site.
The GTU are accessible at any time via a link at the bottom of the Site page.
2. Acceptance of the GTU
Any access to or use of the Site implies full, complete and unconditional acceptance of these General Terms of Use. If you do not wish to accept all or part of them, you are requested to refrain from using the Site.
You acknowledge that these GTU constitute a complete and exclusive agreement between you and ORIENTIS DISTRIBUTION LLC regarding your use of the Site.
ORIENTIS DISTRIBUTION LLC reserves the right to amend the terms, conditions and notices of the GTU at any time, which shall be deemed accepted upon consultation by the User.
The failure of ORIENTIS DISTRIBUTION LLC to enforce any right or clause shall not constitute a waiver of its right to do so subsequently.
3. Liability
ORIENTIS DISTRIBUTION LLC undertakes to exercise all necessary care in implementing the service offered to you.
The Site endeavours to provide accurate and up-to-date information. However, this information is provided for guidance only and is not contractual in nature. Furthermore, this information must be considered at the time it is published online and not at the time the Site is consulted.
To the fullest extent permitted by applicable law, and without prejudice to the rights mandatorily guaranteed to consumers by their national legislation, ORIENTIS DISTRIBUTION LLC disclaims all liability in the event of:

6. “Games and Competitions” organised by ORIENTIS DISTRIBUTION LLC and its partners
ORIENTIS DISTRIBUTION LLC may organise games and competitions on the Site. Participation in these games or competitions requires your active involvement, in particular by completing an entry form or entering a participation code.
Notwithstanding the rules of the promotional game or competition relating to the participation in question, the prizes are available exclusively while stocks last. Furthermore, prizes won may neither be transferred nor exchanged and may not be subject to any form of compensation.

· by ticking the box « I subscribe to the Newsletter to receive exclusive offers and the latest news. » when registering for the « KusmiKlub » loyalty programme
You may unsubscribe from the KUSMI TEA newsletter at any time by clicking on the unsubscribe link located at the bottom of each newsletter and entering your email address.
8. SMS
You may subscribe to KUSMI TEA SMS campaigns in order to receive information about KUSMI TEA news and events by ticking the box « I receive offers by SMS. » when registering for the « KusmiKlub » loyalty programme.
You may unsubscribe from KUSMI TEA SMS campaigns at any time by sending the words « Stop SMS » to the number indicated in each SMS sent by ORIENTIS DISTRIBUTION LLC.
9. Disputes - Applicable law
Language and applicable law:
These General Terms and Conditions of Sale and the sale of Products are governed by French law. However, if you reside in the United States, the application of French law shall not affect the mandatory consumer protection provisions provided for by the laws applicable in your state of residence.
The GTC are drafted in French. Translations may be made available to customers for information purposes only. In the event of any discrepancy in interpretation between a translated version and the French version, the latter shall prevail, without this depriving the consumer of the mandatory rights granted to them by the legislation of their country of habitual residence.
Dispute resolution:
In the event of any difficulty relating to an order, delivery of the Products or performance of these GTC, the Customer is invited to contact ORIENTIS DISTRIBUTION LLC customer service as a priority at contactfr@kusmitea.com, in order to seek an amicable solution.
Jurisdiction:
If no amicable agreement is reached within a reasonable period, any dispute or claim arising from or related to these GTC shall be subject to the jurisdiction of the French courts, without prejudice to the mandatory rights enjoyed by the Customer under the consumer protection laws applicable to them.
