Your email address may also be collected through a third party as part of the purchase for you of an e-gift card. In fact, the e-gift card customizable is sent only by email to the recipient's email address that the buyer provided at the time of purchase. This is a unique code that can be printed and used immediately. This data is collected and processed only as part of sending the e-gift card, for informational purposes, and will under no circumstances be used for commercial or advertising purposes. In this context, your email address will only be kept for the duration necessary for processing. of this offer, namely until the day of use of the unique code on the Site and at the latest one (1) year from the date of purchase.
For what ?
The processing of this data is necessary for us to achieve the following purposes:
· Creation and management of your online customer account and shopping cart;

Regarding promotional SMS : You can subscribe to SMS campaigns from KUSMI TEA in order to receive information about news and events from KUSMI TEA, by checking the box “I receive offers by SMS. » when registering for the loyalty program «KusmiKlub »
You can waive this at any time by sending the words “Stop SMS” to the number indicated in each SMS sent by ORIENTIS GOURMET.
Furthermore, after browsing our Site, you may receive an email even though you have not directly provided your email address to the ORIENTIS GOURMET Group. However, this sending is only possible subject to your express consent. Indeed, we use service providers to identify, using the cookie technique, Internet users who have visited our Site and to send them personalized emails. These service providers have undertaken to obtain, under their own responsibility, your email address via their partners who have already lawfully collected your address and to whom you have expressly consented to the sending of advertising by third parties. Regarding targeted advertising:
· On social media platforms: in the event of your express agreement, your email address may be shared in hashed form with Facebook, for the purposes of communicating promotional offers via the Facebook custom audience service (“Facebook Custom Audiences”). This service allows us to collect anonymized information including age, gender, device platform and interests as well as to create customer lists in order to submit targeted advertisements to them, including on their Facebook page. The hashed information does not allow Facebook to use it other than to identify a customer already existing on Facebook and send them targeted advertisements. 2.3. Specific information relating to data concerning minors
The offers on our Site do not target and are not intended for children within the meaning of Article 8 of Regulation 2016/679. 3. ON WHAT LEGAL BASIS(S) ARE YOUR DATA PROCESSED?
The ORIENTIS GOURMET Group needs to process certain data concerning you to the extent that these are, depending on the case:
- necessary for the execution of a sales or service contract or pre-contractual measures taken at your request (for example, to process your order),
- necessary to comply with legal or regulatory obligations (for example for billing purposes),
- necessary for the purposes of the legitimate interests pursued by the ORIENTIS GOURMET Group or a third party provided that your interests do not prevail over the latter (for example, for transaction security purposes or for the analysis, optimization and personalization of our online offers),

Whatever the processing concerned, the ORIENTIS GOURMET Group only processes your data within the limits provided for by the applicable regulations.
4. HOW LONG IS YOUR DATA KEPT?
Your data is kept for the period during which you use our services, and deleted at the latest three (3) years from our last contact (such as your last purchase, or your last click on a hyperlink contained in an email), unless this data is anonymized in particular for statistical reasons or you consent to a longer retention period.
By exception, the data making it possible to establish the proof of a right or contract, or kept for compliance with a legal obligation, may be subject to an intermediate archiving policy for a period not exceeding the duration necessary for the purposes for which they are kept, in accordance with the provisions in force (in particular but not exclusively those provided for by the commercial code, the civil code and the consumer code).
If you exercise your rights under the conditions provided for in article 7 of this Policy, and in accordance with applicable regulations, data relating to identity documents may be kept for one (1) year and other relevant data collected in this context may be archived for three (3) years.
Finally, the information stored in your terminal (e.g. cookies), or any other element used to identify you and allowing your traceability, as well as the raw attendance data associating an identifier, will only be kept for a maximum period of thirteen (13) months. Beyond this period, your data is either deleted or anonymized.
5. WHO HAS ACCESS TO YOUR DATA?
Your data may only be disclosed to the following recipients or to the following categories of recipients, within the limits of their respective responsibilities and to the extent that this transmission is strictly necessary to accomplish the purposes provided for in article 2 of this Policy:
· Authorized personnel from the accounting, marketing, customer, sales, administrative, logistics and IT departments of the ORIENTIS GOURMET Group, as well as their line managers;
· Third-party companies operating branded stores KUSMI TEA ;
· People responsible for internal and external control missions;
· Hosting and maintenance providers for the customer/prospect database(s);
· Subcontractors, service providers and external companies involved in the execution of sales contracts, CRM actions, in the personalization of Site content as well as the production of advertising content, the carrying out of financial transactions, the shipping of orders and the provision of chat and the carrying out of statistical, marketing and behavioral studies. These entities are required, to the same extent as the ORIENTIS GOURMET Group itself, to ensure data protection.
All persons under our responsibility and companies authorized to access your personal data are bound by a confidentiality commitment.
You are informed that your personal data may be transferred outside the European Union to the American subsidiary ORIENTIS DISTRIBUTION Inc. and its sub-subsidiaries, all located in the United States. In order to ensure your personal data a level of protection equivalent to that offered by the applicable European regulations, ORIENTIS GOURMET has concluded an agreement with its American subsidiary ORIENTIS DISTRIBUTION Inc., in accordance with the contractual clauses validated by the European Commission and the CNIL.
We may also communicate your data in order to respond to legal or regulatory requests, court decisions, summons or legal procedures, if compliance with current regulations requires it, as well as in the event that the ORIENTIS GOURMET Group or one or more of its subsidiary(ies) transfers all or part of its assets to a third party company.
Under no circumstances does the ORIENTIS GOURMET Group sell or rent your personal data to third parties for marketing purposes for their own activities.
Case of social networks: As part of the information collected during the use of social network functionalities (in particular Facebook and Google +), we inform you that such use is likely to result in data exchanges between the ORIENTIS GOURMET Group and said social networks. Some of your information may be transferred to a country other than your country of residence and in particular outside the European Union. We invite you to consult their confidentiality policy in order to learn about the purposes of use, particularly advertising, of the browsing information that these social networks may collect through their functionalities. Payment Providers :
1. SHOPIFY PAYMENTS : All payment phases are carried out via our payment system SHOPIFY PAYMENTS, a PCI-DSS level 1 certified service provider (confirmed by the appearance of “https” in the URL displayed in your browser), in order to ensure the security of payments. This system is fully encrypted and protected. SHOPIFY PAYMENTS does not retain card numbers after transmitting the payment transaction to ORIENTIS GOURMET.
The processing and storage of banking data is carried out by the payment processing organization mandated by Shopify Payments, namely STRIPE PAYMENTS EUROPE, LTD. (company under Irish law). This data is kept in encrypted form for the period strictly necessary for customer relationship management, which may in no case exceed three (3) years from your last order, in accordance with applicable regulations.
ORIENTIS GOURMET only receives information about the payment transaction. For more information, please consult the Terms of use[NB1] and to Privacy Policy[NB2] of SHOPIFY INTERNATIONAL LIMITED.
2. ALMA: Secure payment system allowing you to pay in three (3) installments without fees. Alma may collect the following personal data from us: first and last name, email address, delivery and billing address(es), delivery method (carrier used), bank details, telephone number, date of birth, contents of the shopping basket and purchase history at Kusmi Tea. The Service Provider as part of our customer service : As part of the information collected when using our customer service, we inform you that our service provider, WE CALL, may collect conversational data and, where applicable, communicate this data to third parties in the event of a legal obligation or when these third parties process data on behalf of WE CALL. You can deactivate the use of cookies by selecting the appropriate settings on your browser. However, such deactivation could prevent the use of certain features of the Site.
