Product selection Our teams have been travelling the world for many years, in search of the most reputable tea plantations and the most reliable exporters. Then an extremely rigorous selection process ensures the best mode of transport, optimum storage conditions and the ruthless rejection of any products that don’t deserve to be presented to our customers. We have imposed very strict controls on our supplies to make sure that our teas are free from pesticides and we also test the organoleptic qualities of the teas on a routine basis with our team of tasters. Packaging of the teas We prepare and package our teas in our workshops at Le Havre. Whether it’s a case of loose tea or tea bags, quality remains a top priority. |

Secure payment If you are paying by credit card, the transaction is made between you and our banking partner. The transaction is encrypted (SSL encryption) so the credit card information you provide will never be circulated openly over the internet. No credit card numbers are stored on our servers. Protecting your personal data Type of personal data gathered The data we need to gather relates : - either to you voluntarily registering an e-mail address to enable you to receive our newsletter, - or to you entering your full details in our on-line store (surname, forename, billing and delivery address, telephone number, e-mail address) so that we can process your order. What do we do with this data? The information you give us is never passed on to third parties. Furthermore, you can unsubscribe from our newsletter at any time, by clicking on the “Unsubscribe link” displayed on each one. Under data protection law (French Informatique et Libertés law dated 6 January 1978) you also have a right to access, rectify, modify or delete data concerning you. Cookies These are bits of text sent by a site to your browser. They are stored on your computer to simplify navigation around the site. They help to provide you with customised information, by allowing the server visited to recognise your computer. Then you can for example benefit from our personalised advice or save items in your basket before you carry on shopping. General terms of sale Scope These General Terms of Sale exclusively govern the commercial relations between: THE TEA CONCEPT SAS company, with capital of 150 000 €, listed in the Paris Register of Companies under number 339 407 579, and whose head office is located at 73 Rue Sainte Anne 75002 PARIS, France (referred to hereafter as “the TTC Company”), and The customer (referred to hereafter as the “Customer”) making a purchase on the “kusmitea.com” website accessible at the following address: www.kusmitea.com (referred to hereafter as the “Site”).
Ordering Once the order form has been filled in by the Customer on the Site, the order does not become definitive, and the contract of sale is not concluded, until the order has been confirmed by the TTC Company and the transaction has been accepted by the secure on-line payment system. All our offers are subject to availability. Price The prices indicated in euros include taxes.
Payment Our products must be paid for on ordering by credit card (CARTE BLEUE, VISA, EUROCARD, MASTERCARD, AMERICAN EXPRESS). Signature and Proof For any credit card payment made on the Site, the certificate issued by the e-payment system will prove the amount and the date of the transaction, in compliance with the provisions of Article 1316 etc. of the French Civil Code. The data registered by the payment system will constitute proof of the financial transactions and confirming an order is equivalent to signing and unconditionally accepting all the transactions made on the Site. |

Delivery and shipping charges Delivery Delivery is made to the address that the Customer indicates when placing the order The delivery time-frames are only given as a guide and are not guaranteed. Any delay does not give the Customer the right to cancel the sale, to refuse the products, or to claim any penalties for lateness, or damages, regardless of the causes, seriousness and consequences of the delay Moreover, the time-frames indicated will be suspended as of right by the occurrence of any event beyond the will and/or control of the TTC Company, which cannot be held liable for late delivery in the event, notably, of stock shortages or unavailability of products, interrupted supplies of raw materials needed for manufacture, late or failed delivery by its suppliers, disruption or total or partial strikes (particularly affecting postal services and transport systems), floods, fires, or other cases of force majeure. Shipping charges The Customer is billed with the actual shipping costs in compliance with the recommendations of the French Post Office and Distance Selling Federation. Returns Our products are conveyed at the Customer’s own risk, whatever the shipping method. Right of withdrawal The right of withdrawal does not apply to contracts for the supply of perishable goods, audio or video recordings or computer software where the seal has been broken by the consumer, newspapers, periodicals and magazines, and services which have commenced prior to the end of the 7-day deadline. For other products and services, and under the provisions of Article L.121-16 of the French Consumer Code, the Customer has a period of 7 clear days, counting from receipt of the products, to withdraw. To request a refund, the Customer must inform the TTC Company by registered letter and return the new product, at his own cost, in its intact original packaging, plus any accompanying accessories, instructions and documentation, to the following address: KUSMI TEA Vente en ligne - Service des retours BP 22 - 76700 Harfleur FRANCE If the right of withdrawal is exercised, the TTC Company will refund any order cancelled by the Customer, including delivery charges (but excluding the return charges), within thirty days of receiving the product. In the event of a partial cancellation of an order, the TTC Company will retain the profit from the shipping charges corresponding to the product(s) delivered. Liability The products offered comply with the French legislation in force. The TTC Company cannot be held responsible in the event of non-compliance with the legislation of the country to which the products are delivered. It is the Customer’s responsibility to check with the local authorities whether it is possible to import and use the products or services he intends to order. Intellectual property The TTC Company is the owner of the Site and all its constituent parts, and holds all the rights relating to it. Data protection Under data protection law (French Law N° 78-17 Relative à l’Informatique, aux Fichiers et aux Libertés dated 6 January 1978, amended), the Customer has a right to access, modify, rectify and delete data concerning him. Applicable law and powers of jurisdiction These General Terms of Sale are subject to French law. The rights and obligations of the parties are governed by French law, and more specifically the distance selling regulations (Articles L. 121-16 to L. 121-20 of the French Consumer Code which incorporates EC Directive 97/7 dated 20 May 1997 on the protection of consumers in respect of distance contracts). All disputes and proceedings relating to the commercial relationship existing between you and us will come under the sole jurisdiction of the French courts, whatever their nature and cause.
