General terms of sale

By placing an order with the TTC Company, the Customer accepts these General Terms of Sale fully and without reservation.
The fact that the TTC Company may not invoke, at a given time, one or other of these General Terms of Sale, can under no circumstances be interpreted as the TTC Company waiving its right to invoke one or other of these terms at a later date.
These General Terms of Sale may be amended at any time, without prior notice.

Once the order form has been filled in by the Customer on the Site, the order does not become definitive, and the contract of sale is not concluded, until the order has been confirmed by the TTC Company and the transaction has been accepted by the secure on-line payment system.

All our offers are subject to availability.
The TTC Company reserves the option not to register an order for whatever reason, due in particular to a problem with product supply, a problem with the order received or a problem that can be foreseen with the delivery to be made.
When the Customer confirms his order, he totally and unreservedly accepts these General Terms of Sale which are available to him on the Site, and acknowledges that he is fully conversant with them, thus renouncing the right to rely on any other document or correspondence, or his own general terms of sale in particular.
This confirmation along with all the data that the TTC Company has registered will constitute proof of the transactions.
If the information entered by the Customer on the Site is incorrect, the TTC Company cannot be held liable for possibly being unable to deliver the product.
The TTC Company reserves the right to cancel any order placed by a Customer who hasn’t paid for a previous order.
The photographs, texts and illustrations which appear on the Site are not contractual.

The prices indicated in euros include taxes.
All the products are subject to French VAT.

Any order will be billed according to the price shown on the Site on the date when the order is registered by the TTC Company. However prices may be amended at any time, without prior notice.
The products remain the property of the TTC Company until the price has been paid in full. The following discounts are available, depending on how much of a same loose tea is ordered. These discounts relate solely to the “loose refill packs”:

• either a 5% discount for ordering a quantity of between 500g and 875g of the same tea
• or a 10 % discount for ordering 1 kg or more of the same tea
  
  

Payment

Our products must be paid for on ordering by credit card (CARTE BLEUE, VISA, EUROCARD, MASTERCARD, AMERICAN EXPRESS).

The information transmitted is encrypted and never circulated openly over the internet. The security protocol used (SSL) guarantees the complete confidentiality of personal information transmitted over the internet.

The Customer’s order cannot be processed until his payment has been accepted and this acceptance has been transmitted to our services by our partner bank.

Any non-payments or payment problems (wrong credit card details, insufficient funds in the customer’s account, etc.) will incur a 20 € charge per payment problem.




Signature and Proof

For any credit card payment made on the Site, the certificate issued by the e-payment system will prove the amount and the date of the transaction, in compliance with the provisions of Article 1316 etc. of the French Civil Code.
The data registered by the payment system will constitute proof of the financial transactions and confirming an order is equivalent to signing and unconditionally accepting all the transactions made on the Site.

Moreover, the time-frames indicated will be suspended as of right by the occurrence of any event beyond the will and/or control of the TTC Company, which cannot be held liable for late delivery in the event, notably, of stock shortages or unavailability of products, interrupted supplies of raw materials needed for manufacture, late or failed delivery by its suppliers, disruption or total or partial strikes (particularly affecting postal services and transport systems), floods, fires, or other cases of force majeure.

The Customer is billed with the actual shipping costs in compliance with the recommendations of the French Post Office and Distance Selling Federation.
They are calculated on the basis of the weight of the parcel and its destination.
The Customer is liable for any customs duties that need to be paid.

All the shipping costs are payable by the Customer.

Returns

Our products are conveyed at the Customer’s own risk, whatever the shipping method.
We guarantee that the products are in perfect condition when they are transferred to the carrier. It is up to the Customer to always check his parcel as soon as it is delivered to him by the carrier.
The Customer has a period of three working days counting from receipt of the products to send the carrier and the TTC Company, by a registered letter requesting an acknowledgement of receipt, any complaints he may have about any damage or partial loss affecting the products delivered.
Furthermore, any complaint relating to a patent defect in the products, for whatever reason, must be sent to the TTC Company by registered letter requesting an acknowledgement of receipt, within eight days of receiving the products ordered. At the expiry of this period, the Customer will be deemed to have unreservedly accepted them.
The Customer will provide the TTC Company with all the evidence needed to support his complaint.
If it is proven that the damage or partial losses are due to the TTC Company, this party will, as it chooses and depending on the availability of stock, either process an exchange or take back the returned products. Any return will result in the granting of a corresponding credit.

In the event of a complaint, the transportation costs and other charges (e.g. customs duties) for returning the products to our address will be payable by the Customer.

Liability

The products offered comply with the French legislation in force. The TTC Company cannot be held responsible in the event of non-compliance with the legislation of the country to which the products are delivered. It is the Customer’s responsibility to check with the local authorities whether it is possible to import and use the products or services he intends to order.
If, in spite of all the care taken by the TTC Company, the products delivered to the Customer reveal a hidden defect, the TTC Company can, as it chooses, eliminate this defect or replace the faulty product with another.
However the Customer is solely responsible for choosing the products, storing them and using them once they have been delivered. The TTC Company cannot be held responsible for any non-material damage or physical injury that might result from the improper use of the products.

Moreover, the TTC Company cannot be held liable for all the problems and damage inherent in using the internet. In particular, any disruption to the provision of the service, or any outside intrusion or presence of a computer virus, cannot be blamed on the TTC Company. 

Intellectual property

The TTC Company is the owner of the Site and all its constituent parts, and holds all the rights relating to it.
Copying or downloading all or part of the content of the Site without the prior written authorisation of the TTC Company is prohibited.

Data protection

Under data protection law (French Law N° 78-17 Relative à l’Informatique, aux Fichiers et aux Libertés dated 6 January 1978, amended), the Customer has a right to access, modify, rectify and delete data concerning him.

All disputes and proceedings relating to the commercial relationship existing between you and us will come under the sole jurisdiction of the French courts, whatever their nature and cause.
